It remains very hard to understand how abortion was ever allowed to become the "law of the land" when it was never legislated, and never even should have been adjudicated. Abortion is not in Article One Section Eight of the Constitution, and therefore it is completely out of scope for the federal government. It should never have even been addressed by any branch of the federal government; it is an issue subject only to state and lower jurisdiction, not federal.
Federal abortion "law" is unconstitutional on its face, and should be declared unconstitutional, null and no standing law or legal precedent, by a President or by a Congress. (See the Principle of Constitutionality).
Roe v Wade and Doe v Bolton, and any and all following related cases, await a declaration of nullity due to unconstitutionality, by a President or a Congress. The Court never should have entertained the cases, because they are out of constitutional scope. In making the decisions they made, the Court essentially established New Law, which was unlegislated, unsigned, unrepresentative and thus unconstitutional, through the establishment of Legal Precedent.
Thus, not only did the Court overstep its own constitutional bounds in hearing the cases in the first place, but in adjudicating them as it did it also unconstitutionally usurped the exclusive legislative authority of the Congress in the judicial making of New Law. In direct violation of the sworn oaths of office of all members of the Court, on two counts.
As pointed out in the Abortion page, in setting the legal precedents of Roe v Wade and Doe v Bolton, the Court, unconstitutionally, abrogated and struck down existing representative, legislated state laws as they stood at that time in all 50 states and the District of Columbia.
In hearing and adjudicating these cases as they did, the Justices identified themselves as domestic enemies of the Constitution they were sworn to protect, and opened themselves up to charges of treason.
As pointed out in the Pro-Choice page, the "Woman's Right To Choose" is a sly political distraction. There is only one "choice" they are talking about here, and that is the woman's right to choose to abort someone else: the developing baby in her own womb. There is no such right, in the Constitution, or in the Natural Law which is, not just coincidentally, God's Law.
Aborting people is not a woman's health issue. That's another lie. There is nothing healthy about abortion, either for the baby or for the woman. Abortion is an extremely unhealthy activity, deadly for the baby and very risky for the woman. Whatsoever goes against nature goes against good health. No one is made more healthy through abortion.
The claim that an unborn human being is not a living human being is a flat out denial of science. The DNA proves it, from even before conception. Yet Supreme Court Justices and arguers before the Court present convoluted opinions on the "beginning point" of human life in the womb.
Life, for a new unit of any species, does not begin; it continues. It is transmitted, not begun.
A species begins through some event that we might call its Genesis, and it comes to its end through some event that we might call its Extinction.
Between those two events, no unit of the species just goes "poof" and
comes to be. Life, in a continuous manner, is transmitted from parents
to children, without life ever being interrupted, else the new unit
would never come to be.
In the case of human beings, the sperm cell and the ovum cell are both alive, and both contain the exact same unique human DNA that may be found in every living cell of the individual parent they came from. If both the sperm and the ovum were not human or not alive, pregnancy could not and would not occur.
When the sperm and ovum unite and pregnancy occurs, instantly, in a flash of light, the two strands of DNA combine to form a new and absolutely unique DNA that will be eventually contained in every living cell of the new fully developed human being.
At every point in the process, there is life, and that life is scientifically identifiable as human. That is just simple inescapable scientific fact. To hold otherwise is to deny science.
As far as the law is concerned, in America, if it is alive, and if it is human, then it has Constitutional rights.
Very simple; nothing to it.
Abortion is not a federal issue and not subject to federal law. The claim that the anti-abortion morality is forcing their morality on the pro-abortion immorality is exactly opposite of the truth. It is the pro-abortion immorality that has illegally and unconstitutionally and without due representation through legislation imposed it's blatant immorality upon the whole nation, through the judiciary.
States had, and still have, every legal right to ban abortion, as they did before Roe v Wade and Doe v Bolton, and so do lower jurisdictions.
If the enemies of Life would like to impose their immorality upon the rest of us through Constitutional action, they are perfectly free to try to amend the Constitution to do it.
As it stands now, federal anti-abortion laws are unconstitutional, and those who imposed them on the nation against the will of the people violated the Constitution and violated their oaths of office to do it.
And that's the way it is.
Again, as in all the other Breaking Unconstitutional-ism pages, Constitution-minded President or a Constitution-minded Congress could simply strike down Roe v Wade and Doe v Bolton by simply declaring them to be unconstitutional legal precedents, and therefore null, void and no law, from that date forward.
There is no need to pass any law or even debate anything. It could be undone by a simple declaration, as the Court did in Maybury v Madison. The Constitution nowhere grants any special interpretive authority to any one of the three co-equal branches of government. They are intended to be checks on each other.
The American Constitution
is a simple legal document, written in English, that says very specific
legal things. Any eighth-grader can read it and understand it.
There's nothing complicated about this. It needs no "interpretation" by
any learned body. The English is clear; it is self-interpreting. All
anyone needs is the ability to read to know that this decision as
unconstitutional on multiple grounds.

In the 70's I was in a public hospital awaiting the birth of my son who was born outside of marriage, I was giving him up for adoption as his father had no interest and promised to make me homeless. At that time in NYC. You could have an abortion if it was suspected that traumatic problems would happen <remember Rockefeller?> I had just given birth and the Priest came around to hear confessions, and asked me if I was sorry. I said that I was not sorry for the birth of my son but really sorry for the circumstances into which I had caused him to be born and the Priest refused to give me absolution. I saw women who were ethnic minorities having their 3 or 4 babies out of wedlock getting absolution. He had not problem in a public ward walking away from me so that everyone knew something was seriously wrong and it could not just having an out of wedlock baby as he was willing to give them absolution. He would not go into the abortion ward, but was willing to deny and not accept my heartfelt love. This let me be away from my beloved Church for many, many years. This P.C crap has being going on many years and has done major damage to thousands of souls. I was lucky that eventually I got back to my Soul and and my reason for existing. I still struggle to get back to what I was brought up to believe in and live out. Pray for me and all the women who will meet these unworthy men of God.

The Lord knows; take comfort in that.
I have learned that there are as many kinds of priests as there are kinds of men in other vocations. They most often start out full of zeal, and full of the spirit, but often someone or some part of the system takes that out of them, or modifies it for the worse. Just like our politicians.
Today it is most likely worse than it was back then. It sometimes seems to me that there may be as many Catholic clerics as politicians who have gone Marxist, knowingly or not.
It is good, and a blessing that you chose life for your little one. Think of all the poor women who made the wrong choice, and who agonize over it for years and years and years.
Rachel could not be consoled. That is nature calling. That is God's law, in action, in this world.
We will pray for you, Maria. Please pray for all those women who may never know peace in this life, because a part of them is gone, forever.
And pray most of all for the day when, once again, our religion drives our politics, through us, rather than our politics driving our religion.
Never be lukewarm.
Life itself demands passion.
He who is indifferent to God has already forfeited his soul.
He who is indifferent to politics has already forfeited his liberty.
In America, religion is not mere window dressing and citizenship is not a spectator sport.
Do not allow our common destiny as a whole people to just happen without your input.
