Defining Presidential Treason for the Court

Does the Constitution Define the Court, or does the Court Define the Constitution?

Our whole premise that the United States is the only country known to have no human ruler who is not himself ruled by the Constitution rests on the idea that the Constitution rules the Government, and thus the Government cannot and does not rule the Constitution. At question regarding that point is whether the obvious treason committed by Comrade President Barack Hussein Obama peace be upon him while in office can be tried for treason committed while in office, but discovered after he is out of office.
