As American political weapons go, the Unconstitutionality Weapon is by far the most unrecognized and unutilized in American political history. As shown in the Unconstitutional Judicial Review treatment, one of the Supreme Court's first actions after it was born was to violate the constitution by establishing itself, via legal precedent, to be the sole and final arbiter of what is and what is not constitutional.
Where in the Constitution does it say that the Supreme Court is the ultimate arbiter of constitutionality? Nowhere. It doesn't.
So who is the final arbiter of constitutionality?
It's not a who, it's a what. It's the constitution itself. The constitution rules the government. No part of the government rules the constitution. Constitutionality of any law requires:
- A literal interpretation of both the written words of the law being examined and the pertinent words of the constitution.
- The actual legal intent of the authors of the words at the time they were written, considering,
- the English etymological meaning of the recorded words at the historical time they were written.
There is no mere government ultimate arbiter of constitutionality regarding law. The three branches of federal government are coequal branches; none have any authority over the other two in determining what are and what ae not constitutional laws or actions. All three branches must know the constitution because it defines each of them and gives each of them their full operating instructions.
The Congress legislates and originates Bills; the Presidency signs Bills into Laws (or not) and enforces Federal Laws; the Judiciary adjudicates cases in Federal Law, and acts as the final Court Of Appeals.

It's the Unconstitutionality of the Whole Government versus Trump. It isn't just the Washington Swamp against Trump and against America; it is also the Dominant Unconstitutionality in American Government.
American Unconstitutionalism in the Constitutional Government. Rush Limbaugh is Mistaken about our 242 year history of Constitutional Rule-of-Law. Close, but no cigar. All three branches have violated the Constitution and their oaths of office with impunity, and they just keep doing it. American Unconstitutionalism now rules us.
Cat Fights over Leadership of Unconstitutional Bureaucracies. If what a bureau does is not even listed in Article One Section Eight, and it is thus out-of-scope for the government to even address, then, why does it even exist?
Separation Of Powers says that no branch can legally do what another branch is constitutionally established to do. Nor can any branch order any other branch in how to fulfill its constitutional mandate. From that, the prohibition of any branch having constitutional interpretive powers in any way superior to the other two branches logically flows.
The legislative and executive branches have political ,i.e., policy authority superior to that of the judiciary, because they are elected and representative, and the judiciary is not. But that is political authority, not legal authority. The judiciary has nothing to say about political policy for the judiciary is not political. State and citizen representative policy at the federal level is established by the legislative and executive branches, for if it were otherwise it would not be representative.
President Trump should stop wasting his time appealing district court orders to derail or stop implementations of his political policies and start dissolving whole district courts who are acting to support Marxocrat Party political policies and oppose Republicrat Party political policies.
Whether he knows it or not, President Trump has an unsheathed and seemingly unknown and, so far, politically invisible unconstitutionality weapon that could make America constitutional again, and thereby make America great again, and do it in short order. All he has to do is unsheathe it and use it.
It's just hanging there from his belt waiting to be drawn out and used.
Just as the court did in Marbury v Madison, the President could simply nullify any unconstitutional law just by simple declaration, so long as the written words of constitution itself agreed with that action. The President is solemnly sworn in his very oath of office to protect the constitution from all enemies, foreign and domestic. He should be considered by all to be the final defender of the original intent of the authors behind every word of the constitution, and to not allow it to be misconstrued or modified by anyone, whether for political advantage or for usurpation of governing authority from the written constitution.
These constitutional facts do not grant the Presidency any more power, nor do they make the President into a tyrant or a dictator, for they do not allow him to make any new unconstitutional law or new interpretation of law, but only to nullify that which is already unconstitutional. Delving into original meaning and etymology of the words of the constitution and the law move toward a more forensic and empirical approach that, when properly applied, produce results difficult if not impossible to politically refute.
Results that should have been being pursued by the whole federal government throughout the entire life of the Constitutional Republic.
Constitutionally, the federal government is supposed to be quite small and extremely limited in scope. All federal legal power is constitutionally concentrated on national security, domestic tranquility (law and order), a protected national currency, interstate and international trade and commerce, protecting the rights of citizens and states, and controlling borders and immigration.
Within those limitations, the legislative branch legislates bills, the executive branch signs them into laws and then enforced those laws, and the judiciary branch adjudicates cases in those laws, and that's it.
The powers of the federal government are limited and enumerated.
Here are the constitutional limitations on the creation of federal laws:
[From Article One of the American Constitution:]
Section. 8. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;
To borrow Money on the credit of the United States;
To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;
To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;
To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;
To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;
To establish Post Offices and post Roads;
To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;
To constitute Tribunals inferior to the supreme Court;
To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations;
To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;
To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;
To provide and maintain a Navy;
To make Rules for the Government and Regulation of the land and naval Forces;
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;
To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings; — And
To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.

[Note 1: These are the limited and enumerated legislative powers of the Congress. Nothing outside of this list may be addressed in federal law short of passing a Constitutional Amendment to do it.]
[Note 2: If it cannot be Constitutionally legislated into law, it cannot Constitutionally exist in federal law. The Constitution nowhere grants the Congress the power to "delegate" any of it's exclusive legislative powers to any lesser body or bureaucracy that may exist or be brought into existence. Thus, no "regulation" may be issued to do that which the Congress is specifically prohibited from doing.]
[Note 3: No executive order or action of any kind by the President may establish any rule, regulation or law that the Congress is specifically prohibited from legislating.]
[Note 4: If it does not (and Constitutionally cannot) exist in legislated and signed federal law, the Supreme Court may not Constitutionally hear and adjudicate anything to do with it. The Supreme Court may only adjudicate cases involving legitimately existing federal law.]
[Note 5: To quote Article 1 Section 1: "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives." The key word is "All". No exceptions. If it wasn't constitutionally legislated and signed into law, it is no law.]
Whatever is not listed in Article 1 Section 8 of the Constitution is left to the sovereign state governments, local governments and the private sector to work out. The federal government is not constitutionally authorized to interfere with anything not among those limited and enumerated powers.
The first glaring example of unconstitutional law we will address in that regard is Obamacare (the Affordable Health Care Act) because,
- Obamacare continuation after expiration is the whole purported reason for the Schumer government shutdown.
- Obamacare was unconstitutionally legislated into a Bill by Congress, it was unconstitutionally signed into Law by President Obama, it was unconstitutionally modified by the Supreme Court Chief Justice Roberts before being unconstitutionally adjudicated to be "constitutional" by the Supreme Court.
Health Care is not to be found in Article 1 Section 8 to begin with.
Everything the federal government has ever taken over or tried to control that was not in that list has been made worse than it was before, and Obamacare is just one glaring example of that fact.
Others include Education, Environment, Homosexual Marriage, Abortion, Separation of Church and State, Disease Control, Welfare, Housing, Food, Drugs, LGBTQ Rights, Climate, Fossil Fuels, Carbon, Earth Sustainability, Discrimination of any and every kind, etc., etc., etc.
To constitutionally address any of those extraneous issues requires ratification of constitutional amendments to do it.
"Conservatives" are all united on how Obamacare needs to be repealed, and they waste a lot of time, money and effort to repeatedly fail to do that, but all that needs to be done to fix it is to declare it nullified and no law because it is just so obviously unconstitutional on its face.
Obamacare, chief among our giant collection of unconstitutionalities, was brought into being by Political Party action, and note that Political Parties are unconstitutionally existing federal governing authorities, which are unconstitutionally controlling both houses of Congress, selecting our Presidential candidates, and both nominating and approving our Supreme Court Justices. Yet there is no article in the constitution describing Political Parties.
Through corrupted Political Party action anti-American Socialism has been displacing the Constitution and transforming the government and the relationship between the government and the citizenry,
- From small and limited federal government to huge, ever growing, intrusive and all powerful government;
- From an independent, self-sufficient proud citizenry to an almost totally dependent, incompetent, perpetually angry citizenry who see themselves as victims of rather than dependents of government.
What the Political Parties are doing to America is Machiavellian.
Constitutionally, American government is supposed to be small and the citizenry is supposed to be self-sufficient and self-sustaining. In fact, today, the American government is clinically obese, so huge, bloated and complex that it can't get out of it's own way, and a major fraction of the American citizenry are now just about totally dependent on government benefits, and crime, just to survive.
They weren't born that way; they were made that way, by Political Party action. A significant number of American citizens no longer know how to take care of themselves. They need to be taken care of.
Thus, the Presidential sword of unconstitutionality must be wielded with a certain amount of mercy toward the citizenry, at least until they relearn what it means to be independent of government. It could mean some expenditure of federal funds to State governments, local governments and private sector charities to ease the pain of federal benefit cutoffs.
Still, in our view, the Unconstitutionality Weapon is the best and most powerful political weapons in President Trump's political arsenal.
May he use it wisely.
