At least as long ago as the 2009 publishing of the Separation of Church and State article, and probably earlier, we have talked about someone (President Trump?) establishing a new constitutional principle of Presidential Review, in the exact image of the existing constitutional principle of Judicial Review.
Judicial Review was established in adjudication of Marbury v Madison in 1807, in which the Court struck down an unconstitutional law. They simply declared it to be unconstitutional and therefore null and no law.
The constitution nowhere grants any special oversight or interpretive authority over itself to the court, or to any one of the three coequal branches of the federal government. All must know the Constitution to perform their function. All are sworn to uphold it, obey it, be constrained by it and protect it. The constitution gives the Congress, the Presidency and the Court their full and complete operating instructions in the performance of their respective offices.
We have often said, most recently in calling for an Election Do-Over and again in Trumpian Nullification of Unconstitutional Elections (and laws), that the Congress and the Presidency, being coequal branches with the Supreme Court, have exactly and precisely the same power and authority to declare anything that is unconstitutional to be null and void.
The fact that the Congress and the Presidency have set the precedent of granting the Court superior interpretive and oversight authority over their (and our) constitution until now does not impede a President or a Congress from recognizing and correcting unconstitutionality when they see it. We (and they) are not ruled by precedent, but by our constitution, and nothing and no one else.
Look at all of their oaths of office. Read them all, word for word.
It doesn't matter whether any state election is or is not certified; it doesn't even matter if the electoral college meets and elects Biden and the Marxocrat Party. So long as Trump is President, he has the Constitutional authority to declare the 2020 election to be fraudulent and therefore unconstitutional, null and void.
And if the courts won't do it, and if they let this fraud stand, then Trump has no choice in the matter. This is not about his presidency. This is about the continued existence of Constitutional America. If the election process is allowed to be controlled by an unconstitutional political party who's very public political agenda clearly identifies that party as a domestic enemy of the constitution, then the sitting President must act to preserve the constitution.
It is the electoral process and the constitution itself that is at risk here.
Detractors in the mainstream news media, including even those in Fox, and all political detractors, including Republicrats, who claim that Trumpian defiance is what is causing a constitutional crisis, and that he should just accept defeat and ride into the sunset, are either
Trump didn't cause this crisis. Marxocratism did.
Our constitution remains a legal document, written in English, that says very specific legal things. It is, as it declares itself to be, the supreme law of the land in our America.
And anyone who says otherwise is a liar.
It was written to and for us, the lowly citizens, almost as a love letter.
The only thing Truth has going for Him in this world is us.
