Transactional Capitalism cuts to the chase. It gets back to the original idea of the personal handshake deal, or as close as it can.
The only thing wrong with Capitalism as it exists in the USA is that it is not allowed to be Capitalism. Too many parties extraneous to the fundamental buyer-seller transaction are involving themselves in the transaction, complexifying it, regulating it, restricting it, rearranging it, insuring it, getting a cut of it, corrupting it or even stopping it.
The only thing needed in a transactional capitalist deal is an offer and an acceptance. A contract, in other words, and a handshake between honest participants is preferrable to a paper contract. So long as the transaction is honest, aboveboard and doesn't involve any thing illegal or immoral, if neither the buyer nor the seller have a problem with it and no one is defrauding anyone, there is no need to involve anyone else. They make the deal and live up to their parts of the bargain. Nothin' to it but to do it.
Note well that anything the federal constitution says is unconstitutional to begin with would take a ratified constitutional amendment to make it constitutional for the federal government to deal with in the first place.
Transactional Capitalism in Education
Once upon a time in America most everyone was home schooled up to a point and self-educated after that point, wherever it was. That describes the education of Ben Franklin, George Washington and Abraham Lincoln. There were scattered grammar schools, private schools and paid tutors, but most families were also schools for their own children. Whenever and wherever children were sent to any school outside the home the parents (or the students) paid the educator or the educating institution, and that was it. A very simple transaction, with nothing more than a buyer, a seller and an agreed price.
Note well that, no matter what the Marxocrat Party may say about it, education is not a right. It is a need, but not a right. All needs are not rights.
To paraphrase Yogi,
if people don't want to go to school nobody's gonna stop 'em.
The individual teacher-pupil transaction is what American education needs to get back to. How to do that?

- Education is a matter of state government, local government and private sector jurisdiction, and not a federal matter.
- Get the federal government out of it altogether, because education is not among the limited and enumerated authorized powers of the federal government in the first place, which makes the entire department of education unconstitutional.
- Shut down the federal department of education and fire everyone in it.
- Cut off all funding to public and any other schools, including all federal funding given to colleges and universities.
- Consider sending some of the saved tax dollars back to citizens to help them pay tuitions to the schools of their own free choice.
- Encourage state and local governments to likewise end funding education as much as politically possible to encourage a return to educational institutions depending on parents and student tuition payments as a sole source of institution revenue.
- Consider sending some of the saved state and local tax dollars back to citizens to help them pay tuitions to the schools of their own free choice.
- Consider privatizing public schools by "gifting" them to the current faculty and teaching staffs after cutting all government support. They would then and thereafter sink or swim in open competition by earning, keeping and growing tuition income from satisfied parents and/or students as their sole source of income.
- Newly privatized public schools would be competing with private and parochial schools for pupils and satisfied tuition payers. Like them, they would be paying utilities, building and grounds maintenance, payroll, benefits and union dues strictly out of tuition revenues.
- If teacher's unions would then be "bargaining" with parents and students, not governments, and if they went on strike, it would be against the tuition payers who are free to move their tuition payments elsewhere, rather than against any level of government, taxing authority or arbitrator.
(Currently, the taxpayers who fund public schools are the only ones excluded from the union contract bargaining table, but not from paying for everything to do with education, including all union contract settlements.) - Privatized individual formerly public schools would then face economic reality like everyone else, start pleasing their customers, get their expenditures under control, get competitive and become top notch educational institutions, or sell the school to someone who can and go out of business altogether.
Transactional Capitalism in Health Care
Once upon a time in America medical doctors were private business men, most of whom operated their businesses from rooms in their own personal homes and had privileges at local hospitals. When doctors "made their rounds" those rounds included the homes of their patients and the hospital(s) where any of their patients were admitted. They were normally the doctor of whole families, not just someone in the house, and whenever the doctor came around to make his house call, everyone in the family was examined and treated.
And patients paid doctors. Very simple, nothing to it.
Medical care wasn't anywhere near that expensive in those days. Still, some people paid in part with whatever they had available, like eggs, vegetables or services of some kind, some people were treated for free, as charity cases, and hospitals had "charity wards" for the indigent. Medical doctors still prospered at a higher level than most people and were always among the most respected and beloved members of any community.
Note well that, no matter what the Marxocrat Party may say about it, health care is not a right. It is a need, but not a right. All needs are not rights.

The individual doctor-patient transaction is what America needs to get back to. How to do that?
- Both health care and insurance are matters of state government, local government and private sector jurisdiction, and not federal matters at all.
- Get the federal government out of it altogether, because neither health care nor insurance are to be found among the limited and enumerated authorized powers of the federal government in the first place, which makes the entire Obamacare law unconstitutional, all federal health care bureaucracies and health care insurance bureaucracies unconstitutional and therefore illegal at the federal level.
Declare Obamacare to be null and no law, shut down the CDC and all other federal health and insurance bureaucracies and fire everyone in them. - Consider sending some of the saved federal expense dollars back to the citizens to help them pay for health care.
- Kill the medical practice "Billing Code" in the Medicare system that has spread out to the now federally controlled private sector medical practice, spoken of among the Socialized Medicine pages, and perhaps in the most detail among the Work at Home Jobs that have had me.
- Encourage states and the NAIC (National Association of Insurance Commissioners) to radically shake up the health care insurance industry, for example to start,
- Making the insured parties the owners of the health care policies rather than the employers, so that the policies go with the insured parties when they leave employment.
- Making the insurance switch to a new payout mode with suspended premium payments for the duration of any catastrophic illness.
- Making the insured citizen the payout beneficiary of all health care insurance policies rather than the health care providers. This would break the insurance industry's billing-code driven regulatory strangle-hold on health care providers.
- Encourage employers to stop including "benefits" other than pay in hiring employees, most especially to stop offering health care insurance as an employee benefit. This would make personal health care insurance a lot more affordable for most people.
- Encourage citizens to buy catastrophic illness insurance only, and to subscribe to Concierge Medical Practices for everything else, from setting broken bones to commonplace surgeries, child births, and everything from pediatrics to geriatrics.
- Encourage doctors to partner-up and form Concierge Medicine Practices in which patient-customers pay monthly fees directly to the practice instead of pay-as-you-go for every treatment. This would help break the enslavement of medical doctors to giant multi-hospital conglomerates that have turned medical doctors into paid employees instead of the independent professional businessmen they were educated to be.
- Get Medical Doctors out of the "paid employee" mold they have been slowly forced into. Where once the medical doctor was an outstanding professional, today most of them are little more than a smiling face on a giant org chart of a health care conglomerate, reporting to some MBA with one third or less of their own educations.
All of this would go a long way toward returning the practice of medicine back to simple handshake transactional capitalism.
Transactional Capitalism in Everything Else
Look through the currently existing federal regulating bureaucracies that are passing nation-wide regulations with full force of law behind them, unconstitutionally and illegally usurping the legislative power that the constitution exclusively assigned to the Congress and the Presidency. Look further to see if the subject matter being regulated is among the constitutionally limited and enumerated authorized powers of the federal government. And if it's not in that list, ask yourself what the hell the federal government is even doing addressing it at all, let alone regulating and controlling it.
Just looking at the EPA (Environmental Protection Agency) as one classic example among the many, why on earth should anyone expect any arrogant army of know-it-all petty bureaucrats living in Washington D.C.to know any more about, for instance,
- Air Pollution than the private sector individuals and corporate entities who breath it.
- Soil Pollution than the private sector farmers, ranchers and homesteaders who absolutely depend on it, produce food from it and eat what grows in it.
- Water Pollution than the private sector citizens who drink it.
- "Limited Resources" than the private sector citizens who mine it.
- Temperatures, weather, climate and sea levels than the private sector citizens who live in it and with it, and who depend on it.
All such federal bureaucracies should be shut down, all their regulations nullified and everyone in them fired.
One last time, to paraphrase that same famous old Yogi-ism:
if Americans don't want to be ordered around nobody's gonna stop 'em.
