There he goes again, I can hear some of you saying, recommending amendments and repeals of amendments to the constitution. But I can't help it. Just about all of the internal and many of the international problems we face today are the result of government violations of the constitution as written and amended. That very thing needs to be not only recognized, but corrected, and the constitution restored to its lawful position as the government of the government. America, including Presidents, Representatives, Senators and Supreme Court Justices are supposed to be governed by the written constitution.

We are supposed to be a nation of laws, not of mere men, and the supreme law of the land is the constitution. That is what is meant by Rule Of Law versus Rule Of Man.

The American Constitution is a legal document, written in English, that says very specific legal things. It legally "constitutes" us as a nation; it makes of America what she is (or what she is supposed to be), which is a nation of citizens, and a representative government, that are all ruled, governed and both freed and constrained by the written constitution.

The constitution - not the currently sitting government - is the true governing government. Governments come and governments go, but the written constitution remains. The constitution is America's ruling fixed peg upon which all Americans alike can depend for consistency, steadiness and good order in law.

Amending the constitution is not an easy process, and it is (or should be) more difficult today, with 50 sovereign and largely self-ruling states rather than 13, and with 370 million sovereign and largely self-ruling citizens rather than a few million. It's not supposed to be easy.

Now that we have a whole (unconstitutionally existing) powerful political party that is socialist and therefore anti-American, amending the constitution via the Constitutional Convention route would be extremely dangerous, because all the Marxocrat Party Marxists in federal and state governments could turn it into a freeforall, repealing the second amendment, constitutionalizing dope, abortion, sodomy, eliminating rights to private property, criminalizing Christianity, etc., etc., etc.

We would recommend the route where Congress draws up the amendment(s), one by one, and sends them out to the states to be ratified by a super-majority of 38 states. Each amendment to have one and only one purpose.

The reason for that recommendation is that we now have so many mostly Marxist anti-Americans in elected and appointed high office in the federal, state and lower jurisdiction offices, all over the country. As just one example of the criminality of these officials consider the clear wording of the Second Amendment, and recognize how every single gun control law in America is both unconstitutional and on the books as enforceable law anyway.

Article the fourth [Amendment II][4]

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Notes:

  • Regulated: Trained as military units in use of arms.
  • Militia: All able bodied men between 16 and 65.
  • The Right is granted to the people.
  • To Keep: To acquire, possess and own.
  • To Bear: To carry.
  • No level of government may infringe the right.
  • All levels of government must protect the right.

Count the gun laws if you can. Count the registration laws and the government maintained registration records. Count the laws licensing and restricting gun dealerships and the mere sales of guns, and interstate sales, and interstate inheritance or gifts between family members or even just friends. Every single one of then is a criminal violation of the Constitution.

Every single one of them was committed by some level of government.

Why is it that US Attorneys under the Department of Justice are always looking to investigate and indict citizens violating unconstitutional gun control laws rather than looking to defend citizens having their constitutional rights violated by some level of government? No American citizen should have to pay attorney fees to defend against unconstitutional government action against them. Their cases should be defended by the federal government at no cost to the citizens.

We used the second amendment as an example just because the violations are so gross, numerous and obvious. But the whole constitution has been and is being violated by the constitutional government, we believe, in the interest of transforming us from a constitutional republic into a nation ruled by pretentious "experts".

Look at Article One Section One:

Article. I.

Section. 1. All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.

The key word in that article is "All", meaning no exceptions. If it wasn't legislated into a bill, passed by congress and signed by a President, it is not and cannot be a federal law affecting every state, every jurisdiction and every citizen in America. Yet we have had unconstitutional federal "laws" on the books established by,

  • Supreme Court adjudication of cases that the court never even should have adjudicated, such as, Everson v Board of Education; Roe v Wade; Doe v Bolton; Obergefel v Hodges; Obamacare; etc.
  • Legislated and signed laws, such as Obamacare.
  • Unlegislated, unsigned, unrepresentative bureaucratic regulations too numerous to list.

Let's look at Article One Section Eight:

Article 1 Section 8:

[From Article One of the American Constitution:]

Section. 8. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To borrow Money on the credit of the United States;

To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;

To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;

To establish Post Offices and post Roads;

To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;

To constitute Tribunals inferior to the supreme Court;

To define and punish Piracies and Felonies committed on the high Seas, and Offences against the Law of Nations;

To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;

To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;

To provide and maintain a Navy;

To make Rules for the Government and Regulation of the land and naval Forces;

To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;

To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;

To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings; — And

To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.

[Note 1: These are the limited and enumerated legislative powers of the Congress. Nothing outside of this list may be addressed in federal law short of passing a Constitutional Amendment to do it.]

[Note 2: If it cannot be Constitutionally legislated into law, it cannot Constitutionally exist in federal law. The Constitution nowhere grants the Congress the power to "delegate" any of it's exclusive legislative powers to any lesser body or bureaucracy that may exist or be brought into existence. Thus, no "regulation" may be issued to do that which the Congress is specifically prohibited from doing.]

[Note 3: No executive order or action of any kind by the President may establish any rule, regulation or law that the Congress is specifically prohibited from legislating.]

[Note 4: If it does not (and Constitutionally cannot) exist in legislated and signed federal law, the Supreme Court may not Constitutionally hear and adjudicate anything to do with it. The Supreme Court may only adjudicate cases involving existing federal law.]

[Note 5: To quote Article 1 Section 1: "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives." The key word is "All". No exceptions. If it wasn't constitutionally legislated and signed into law, it is no law.] 

Look at Note 2 above; Congress and only Congress legislates new federal law, and then try to count the federal REGULATING bureaucracies if you can. The Constitution nowhere grants congress the legal ability to delegate any of their exclusive legislative authority to anyone else.

Yet unconstitutional regulating agencies and bureaucracies have been created to author and enforce federal regulations with full force of law behind them affecting every citizen and every jurisdiction all across the whole nation of America.

Unelected, unrepresentative, unaccountable, unconstitutionally existing, nameless, faceless bureaucrats pass and enforce regulations with full force of law behind them, ruling us all, from Washington DC.

Do you see health care (Obamacare), or food and drugs, or catalytic converters, or the environment, or species, or abortion, or marriage, or homosexuality, or marijuana, or auto exhaust, or the climate, or urban development, or CO2, or child seats among the limited and enumerated powers of federal legislation listed above?

That's funny, neither do I.

Now we see prominent Republicrat politicians in high office calling for a federal nation-wide abortion ban, when they already have one, in the fact that abortion is not listed among the limited and enumerated powers in article 1 section 8. Constitutionally speaking, as if any of them paid any attention to the constitution, if any of them wanted to address abortion in federal law, whether for it or against it, they would first have to amend the constitution to do it and have their amendment ratified by 38 states. 

They don't even know how to do their own jobs.

The Supreme Court established the constitutional principle of judicial review in deciding Marbury v Madison where they declared a law to be unconstitutional and thus null and no law, and rightfully so. But that did not change the written words of the constitution, and the constitution nowhere grants any one of the three coequal branches of the federal government any special interpretive authority over itself that is in any way superior to the interpretive authority of other coequal branches.

What the court did in Marbury the President and/or the congress could do just as well.

  • Congress must know the constitution to legislate federal law.
  • The Presidency must know the constitution to enforce federal law.
  • The Court needs to know the law to adjudicate federal law.

No coequal branch is authorized by the written words of the constitution to dictate the meaning of the words of the constitution to the other two branches. All must know the constitution equally, and if they don't, they should not be holding office.

What we are saying here is that,

  1. a President or a Congress can do exactly what the Court did in Marbury, i.e., declare an unconstitutional law (or precedent, or regulation, or executive order) to be unconstitutional, null and no law;
  2. the Court is not constitutionally authorized to override any such executive or congressional legal actions by mere dint of holding some imaginary superior interpretive authority over the written words of the constitution.

Now, you may say that legal scholars, constitutional lawyers, supreme court justices, congressmen, senators and presidents may disagree with that, and they all claim superior knowledge of the matter than us.

Who cares?

That is variable subjective opinion, not permanent objective reality.

One thing only matters here: what does the constitution say?

The self-interpreting words are right there for everyone to read. If I can read it and understand it, so can you. It was written for us.

  • The constitution rules the government;
  • the government does not rule the constitution.

All federal officials who disagree with that and who swore in their oaths of office to uphold the constitution are liars.

Proposed Constitutional Amendments:

Further Defining Treason:

As we said in Re-Defining Treason and again in Treason Amendment,

Anyone holding sworn-in Constitutional office who then violates the Constitution in the performance of his office, violates his oath office, and commits an act of Treason. The very purpose for Constitutional office holders swearing to uphold the Constitution in the performance of their Constitutional office is to protect the very existence of Constitutional America. If they violate the Constitution after swearing not to, they thereby commit Treason. 

Every violation of the constitution that is allowed to stand brings constitutional America closer to destruction as a constitutional republic.

We submit further that the authors of the constitution did not anticipate the infiltration of political ideologies that are mortal enemies of the constitution and the American constitutional republic, such as Islam and such as all variant forms of Marxism-Socialism, into the American culture and into the American constitutional government.

The fact of the matter is that both Islam and Marxism are at war with America, and even though we have not declared war on them, they most certainly have declared war on us, and are diligently working, even from inside America, even from inside our own government, to destroy us as a constitutional republic.

Article III section 3 says this:

Section. 3. Treason against the United States shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

Our proposed amendment would add two more forms of treason and reword Article III Section 3 as follows:

Treason against the United States shall consist only in:

  1. levying War against them, or in adhering to their Enemies, giving them Aid and Comfort;
  2. Officers of the federal government violating the Constitution and their oaths of office in the performance of their offices;
  3. Citizens and organizations working to violate, undermine, replace, revolutionize or destroy the Constitution and/or the Constitutional Republic of America.

No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

Unfortunately the current violators of the constitution would not be subject to being punished under this amendment because of the principle of ex post facto law by which no one can be charged with a violation of law if the law didn't exist at the time of the "violation" of it. Nevertheless, this amendment, once ratified, would tend to make future would-be violators a lot less powerful and a lot less bold and forthright in their politics, and they would continue in their anti-constitution activity only at grave personal legal risk.

Voting and Fair Elections:

State governments rule national elections. Article 1 Section3:

Section. 4. The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

We would add to Section 4 the following:

All elections with candidates for federal offices on the ballot must in all states

  1. be held on the same one day with in-person voting only;
  2. voting method must be by paper ballot;
  3. all voters must be American citizens registered in the district in which they are voting;
  4. all voters must prove identity with picture identification.

Separation of Law from Politics:

A new constitutional amendment to divorce the American practice of law from politics in the interest of pure application of law.

No Attorneys, Judges, Justices, Officers, Clerks or Other Legal Staff of Any Court or Any Government Agency or Jurisdiction are to be elected to their offices by popular vote. All are to be appointed and approved for office by appropriate jurisdictions based on character and legal qualifications alone.

One Purpose Bills and Ending "Earmarks":

Since it is so difficult to politically establish a "line item veto" to end the practice of adding "you scratch my back, I'll scratch yours" line items to bills for purely local vote-getting reasons, it needs to be ended by constitutional amendment.

New Amendment:

All Bills presented to the President for signature into law must address one and only one issue and must fit on one sheet of paper.

Ending "Baseline Budgeting", Budget Stalemates and "Emergency" Continuing Resolutions:

The current method of not producing a complete budget begins a year before the budget is supposed to go into effect, as follows:

  1.  Federal agencies create budget requests and submit them to the White House Office of Management and Budget (OMB). 
  2. OMB refers to the agencies’ requests as it develops the budget proposal for the president.
  3. The president submits the budget proposal to Congress early the next year.
  4. Proposed funding is divided among 12 subcommittees, which hold hearings. Each is responsible for funding for different government functions such as defense spending or energy and water.
  5. The House and Senate create their own budget resolutions, which must be negotiated and merged. Both houses must pass a single version of each funding bill.
  6. Congress sends the approved funding bills to the president to sign or veto.

Federal agencies who's purpose for being is not listed among the limited and enumerated federal powers in Article 1 Section 8, such as energy and water, should have no input whatsoever into the budget process. They should be declared to be unconstitutional and shut down, and their portion of the budget eliminated.

No issue or purpose for spending on anything prohibited by Article 1 Section 8 can be funded short of amending the constitution to do it.

Since Congress proved itself too incompetent (or criminally corrupt) to be capable of ever passing an honest and complete national budget a new amendment is required.

New Amendment:

No budget from any former budget period is to be in any way related to a following budget; particularly prohibited is the practice of baseline budgeting.

If a new budget is not approved before the next budget period begins all failing-to-comply subcommittee members must lose their seats and be replaced with an entirely new subcommittees.

No budget is to be attached to any omnibus bill or combined with any other bill but must stand alone as a pure one-purpose budget bill.

Complete national budget bills must be submitted on time or all federal spending stops until the budget bill is submitted and approved.

There can be no "Continuing Resolutions" or other ways around passing a complete national budget.

Federal Government Compensation:

New Amendment:

When any federal government official's compensation is increased, all other federal officials and all military members compensation is to be increased equally, expressed as a percentage increase, from the lowest ranking military recruit on up to the President of the United States.

English as the National Language:

New Amendment:

The National Language is English. Holding government office or employment at federal, state or local levels, and entry into the armed forces requires fluency in reading, writing and speaking in English.

National Morality:

This one is difficult because it necessarily touches the first clause of the first amendment of the bill of rights, i.e.,

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;...

Yet the moral standard of the authors of the constitution was inarguably and unequivocally Christian. We have been over the original colonial Christian denominations many times herein; with the formation of the United States, we thus had a mixture of them into an unofficial quasi-national religion of "General Christianity", so named by Benjamin Franklin. While none of them formed our national theology, together, they all formed our national morality.

The vitally important part of that to note is that, although the colonial denominations differed from each other in Christian theology, they all agreed with each other in Christian Commandment-based morality. And they agreed with each other in general Christian culture, for instance, in keeping Sundays as the New Testament Sabbath (Acts 20:7).

That "Generally Christian" morality formed the foundation for all law in the new nation of America. It was the basis for the constitution itself, and it was the beginning point for the legislation of all new federal law. It was - and it still and always should be - how we Americans tell right from wrong. It defines us as a moral people, and shows exactly how, why and by what standard we are moral.

In the formula Culture=Religion+Politics, if you take the religion out of the formula for American culture, what you are left with is a culture that is at best amoral, and in Christian morality, amorality itself is immoral.

No good man may be indifferent to right v. wrong or truth v. falsehood.

National immorality hovers like a dagger held over the heart of American culture and American representative government. Prompted by unconstitutionally existing political party immoral agendas, an amoral American culture would soon slide into the typical immoral "ends justify the means" pure power-mad politics aimed at acquiring pure political power for its own sake, driving at one party rule, the constitution overruled and one-man tyrannical government enthroned.

Just like Lenin's Russia, Mussolini's Italy, Hitler's Germany, Mao's China and Castro's Cuba. And like "Field Marshall" Klaus Schwab's dreamed of Globalist New World Order.

New Amendment:

American law at all levels must adhere to the moral standards of the authors of the Declaration, the Constitution and the Bill of Rights, which moral standard is that of a "General Christianity" that is not specific to any denomination, but a blending of those that existed at that time and were practiced by the authors and ratifiers of the Constitution. 

This moral code insists that all good men promote truth and deny falsehood. Special attention should be paid to political promoters of falsehoods since they seek, through politics, to impose falsehoods on the culture through enshrining them in immoral law.

An example would be Cap'n Planet Al Gore and Traitor John Kerry and their constant blithering on all the lies involved in the Climate Change political hoax. These lies are in line with the agenda of the Globalist Grand Conspirators to eliminate sovereign nations, including constitutional America, and establish a one-man global tyranny.

The "bridge" to global tyranny is the replacement of existing legitimate governments with "government by expert", in which the likes of Gore and Kerry are supposed to be the "experts". But they are not experts. They are liars.

The "experts" see themselves and each other as special, singled-out, elite intellectuals, but what they are is something quite different.

They are conceited self-adulating effete snobs, and general buffoons, intellectually speaking. They have been doubling down on the same old lies for so many years that they may have come to believe their own lies, weak minded as they are. Whatever they believe, they form a mutual admiration society of super elitist, snooty clowns and buffoons.

Climate-Change, like Gender-Affirmation, is Sheer Lunacy.
