Reminder: The Constitution is The Law. How did we ever forget that?
It is Absolute law. The Supreme Law of the Land. The Constitution is the only thing that can make America - the only nation ever based solely on an idea - endure.
Until America, Absolutism referred to an individual, wearing a Crown. Absolutism was born of the revolutions, wars and social upheavals of the European Reformation, spoken of in the Fracturing of Christianity. Absolutism brought social stability and safety to a destabilized Europe, which meant restored peace, order, stable society and normalized commerce.
Louis XIV of France, who typified the Absolute Monarch, was reputed to have said "I am the state", which was quite true. But Absolutism worked well enough for the people only when the Absolute Monarch was a decent individual, but even then, the unsolvable problem with it involved succession to the crown. There could never be any guarantee of the quality or the decency or the goodness of the next Absolute Monarch. And he would be the Absolute Monarch, decent or not, cruel or not, lunatic or not.
The American Idea radically changed all that, by putting the people first, ahead of the state, and ahead of America's own government. The American Idea enshrines Fundamental Civil Rights, found in Natural Law, into the national foundation itself. It then establishes a government legally committed to protecting those Natural Rights of Man, and makes that government subject to The People. It is, as Lincoln described it, government of the people, by the people and for the people.
These four Fundamental Civil Rights are written on the hearts of all men, by God Himself. So says the American Declaration of Independence, which clearly describes the American Idea, enabling The People to institute government specifically to protect those rights, and to abolish government that fails to do it, and then start over.
Now, there's not much we can do about those natural civil rights of all men, way out there in the far flung reaches of the world, except recognize them in all men. We cannot enforce them everywhere, but we can recognize them, and encourage them. And when we recognize and encourage them everywhere, we make of ourselves a recognized good and decent people. The Good Guys on earth.
But here, on this American ground, we can do more than recognize and encourage the four fundamental civil rights; we can enforce them and protect them by force of civil law. That is what the Constitution is for, and that is what the Constitution does.
The ratified Constitution declares itself to be the Supreme Law of the Land. That makes the Constitution itself Absolute Law.
The President is not the law. The Congress is not the law. The Court is not the law. The people are not the law. The states are not the law. The local governments are not the law. The Constitution is the Absolute Law, and all under it are equally subject to it.
The federal government cannot make new law that violates the Constitution. The states can make their own laws, but those state laws cannot oppose or violate the Constitution. So it is with local governments. And so it is with citizens acting in liberty, constrained only by civil law. No action by any citizen, or any government or other entity, can legally act in violation of the Constitution. The Constitution sets the limits and boundaries of all other law, and all other law is lesser law.
What about the principle of Representative Government? Do the Congress, and all the lower state legislatures, not legislate new law at the insistence of and in the interest of the represented citizenry? Yes, but that new law, representative or not, may not exceed the limits of the Constitution, or violate any part of it. We are not a mere Democracy; we are a Constitutional Republic, and our Constitution is Absolute Law. Even new law is constrained and limited by the Constitution.
Amend it for your other, extra-constitutional purposes, if you can.
When anyone asks, where is your Ruler, point at your Constitution. When anyone asks, where is your Law, point at your Constitution. If it constrains you, it also liberates you, and it liberates you to a greater degree than it constrains you. It was written, ratified and amended for you, personally. And for your whole family. Its very purpose for being is to ensure and protect your life, your liberty and your property, and to ensure that your standing in law is absolutely equal to that of every other citizen. And to do the same for your whole family. That is why it came into being.
It is very simple, very brief and quite too the point. I have a copy of the Declaration of Independence, and a copy of the Constitution, along with the Bill of Rights and all the other Amendments, all printed up nicely into a quite thin little pamphlet that slips right into my shirt pocket, with lots of room to spare. Very simple; nothing to it. You don't have to be a Philadelphia Lawyer to understand it. This thin little pamphlet fully (and legally) describes the government of the most powerful nation on earth, and provides it's complete operating instructions. It's like a user's manual, and it is simpler, more straight forward, easy to understand and better done than the ones I have for our cars. Or our phones. Or just about anything. It is simple straight forward English.
To read and internalize the grand idea this little pamphlet encapsulates is to be awestruck at the absolute brilliance of the authors. The whole idea is a far more magnificent accomplishment than any mere work of art. While the Founders and the Framers all worked together in the building of this great idea, Jefferson was the Chief Scribe of the Declaration, wielding the pen, and most of those words are his. And Madison was the Chief Scribe of the Constitution, wielding the pen, and most of those words are his.
It was, in the end, due to collective effort, a work of sheer genius.
They prayed, after all. Just so you know: they prayed.
How does this idea and government organization compare to those of other "free" civilized nations? It is vastly and obviously superior.
Western nations of the Judeo-Christian ethos generally morphed from absolute monarchies into nobility-recognizing Parliamentary Democracies, whether by violent revolution or by political evolution. In every case they were infected, perhaps fatally, with the rise of powerful Political Parties with various political agendas, which were not necessarily in alignment with the good of the government, or the state, or the people.
In England, the first of these political factions, or Parties, were the Whigs and the Tories. The Whigs generally represented the newer radical liberal politics favoring the power of Parliament over the power of the Crown. The Tories, more conservative and traditional, favored the ancient power of the Crown over that of the Parliament.
In the American Colonies, these political sentiments coalesced into the two factions of the Revolutionary War. The "Whigs" became the Revolutionaries, and the "Tories" became the Loyalists, whose battle cry was "God, King and Country!" Many Americans today have not learned that the Revolutionary War was as much a Civil War as it was a war against England; that's quite an indictment of modern American government-driven education.
It was the world's first war against Absolutism Personified.
Looking at the various Western Parliamentary governments alive today, we see many, many Political Parties represented, each with their own wildly varying agendas, few of which put the total nation first. Some countries have as many as thirty, or more, valid, recognized Political Parties, each with some particular cause célèbre, upon which they will not compromise.
This brings about an instability, in that any time a sitting Prime Minister falls out of favor with most of them, or with the most powerful ones of them, they can call for a Vote Of Confidence, or Referendum, which may result in a new special election installing an entirely new government. In some Parliamentary governments, this has meant multiple elections and multiple new governments, in the same year. Two, or three, or more. Any time any sitting government cannot obtain or maintain majority support, there is another national crisis.
The problem is all the Parties, overriding national principles.
The members of the Parliaments are, before they are anything else, all members of the Parties, and they all owe more allegiance to their Parties than to their government or to their nation or to their constituent citizens. The Party's interest comes before the national interest.
Since the 1848 publication of Marx's Communist Manifesto, all sorts of pro-Marxist Political Parties have arisen in nearly all Western governments. Their names may include words like Socialist or Labor, but what they are is Marxist, at the core. All the various Labor Parties, like all the various Organized Labor Unions, were born of the closing lines of the Manifesto: Workers of the World, Unite! Every Parliamentary government that has a Socialist Party or a Labor Party, or both, is infected with Marxist ideology. The most obvious symptom of this Marxist infection is national recognition of the worker's right to a job.
A right to a job, or a right to work, is not a natural law right, like equality, life, liberty or property. It is not a right granted by God, but by man; by government. The fatal flaw in a universal right to work idea is that it must impose upon someone the legal responsibility to provide jobs for the workers. No business is in business solely to provide jobs for workers. How could such a business stay in business?
But a recognized right to work was just the beginning of the slide into utter nonsense. What followed that was a myriad of invented rights, including all sorts of government or employer supplied benefits. Standard of living, unemployment pay, food, rent subsidies, minimum wages, retirement pay, medical care, etc., etc., etc.
And, building upon all of that, came all the equality nonsense. Equal pay, equal wealth = property, equal housing, equal food, equal medical care, equal everything.
In Political Parties: Redirecting Allegiance Away from the Nation, we noted how President George Washington, in his Farewell Address, warned the nation against the formation of Political Parties. He foresaw all of this, and warned us against it. Our first few sitting governments ran and were elected on Principle, not political agenda.
If we do not return to American Principle, we will lose America.
But the Abolition - Slavery moral argument hardened into dangerously belligerent positions against each other, and these positions became America's two largest and most long-lived Political Parties. The Racist Democrat Party came to be solely to oppose the strong, mostly Northern Abolition movement. It actually went anti-American over the race issue, seeking to break up the nation. After losing the Civil War, it had a horrible history of blatant racism and racial suppression.
The Republican Party, born of the Abolition Movement, coalesced around Abraham Lincoln as the Abolition Party, in opposition to the Planters and other slave drivers who formed the Democrat Party.
That these two Parties somehow became "official" in the minds of all Americans, and yet are nowhere mentioned in the Constitution, has led us to our current sorry state of affairs. You have to be a member of one of these Parties to even be nominated, let alone elected, to any office in America.
Isn't that unconstitutional?
The Parties have made themselves all powerful, and, they believe, irreplaceable and invulnerable. They are required now, for the proper functioning of American government. Even though they are extra-Constitutional entities operating in a Constitutional government.
And they both got worse over time.
The Democrat Party morphed into an American version of all the Labor Parties elsewhere; they went Marxist, and became what I call the Marxocrat Party. The whole of the Marxocrat Party agenda, increasingly steeped in Marxist ideology since the Wilson administration, involves growing the government, expanding its scope, collectivization and redistribution of wealth = property, and the sublimation of the Constitution. Its greatest political achievement, thus far, has involved the creation and feeding of a permanent "class" of black American racists who absolutely despise the opposition Republicrat Party in general, and America in particular.
The Republican Party, which I now refer to as the Republicrat Party, morphed into an absolutely pure Political Party, interested solely in politics, and in political favor-currying, political advantage, fund raising, control of large funds, control of political contests, and, now, growing the government just like the Marxocrats.
Both Parties engage heavily in Crony Capitalism = Fascism; the Marxocrats more than the Republicrats, but both Parties are in it up to their necks. Big business and big banks and big money compete with each other, not so much, any more, for honest business in the open market place, as for competition-stifling government favors, through regulations, taxes, tax breaks, penalties, exemptions, etc., and thus, monopolistic control of various corners of the formerly free market. And they pay huge money to the Political Parties for these favors.
Neither Party gives a damn about the Constitution. They care more about their big political donors than their constituents. They are purely and exclusively political, and today I can say that both Parties, as corporate entities, are acting in direct opposition to the Constitution, whether knowingly or otherwise. The Parties are addicted to donor money. They cannot live without it.
Two other factors contribute to our rapid decline as a nation. First, there are all the various "factions" that amount to the same thing as all the many competing, selfish Political Parties in other Western Democracies. In America, since Wilson, and increasing under FDR, they have become established government and bureaucratic administrative agencies, rather than Political Parties. With full power to pass and enforce government regulations with full force of law. Unconstitutional, but established and working, nonetheless.
Second, in Comrade President Obama, peace be upon him, we have our first, twice elected, rabidly anti-American President, who is purposely doing everything in his power to render the Constitution inoperative and irrelevant.
Regarding all the unconstitutional federal agencies reporting to the President, Article 1 Section 1 of the Constitution says:
The key word here is the first word: "All". There is no other legal source of new federal law in America. Not the President; not the Court; not any bureaucracy. All law originates in Congress and nowhere else. The Constitution nowhere grants Congress the authority to "delegate" any of its sole legislative authority to any other entity it may invent or call into being. None of these giant regulating bureaucracies enumerated among the Cut The Spending pages has any true Constitutional standing in the American government.
Instead, they are a near mirror image of all of the Soviets - administrative agencies - of the Soviet Union. A giant pile of bureaucracies and sub-bureaucracies, all eventually reporting to a Supreme Soviet - the Cabinet - which in turn reports to the Supreme Dictator. Untold millions of bureaucrats and petty bureaucrats "administering" the unrepresented citizenry, at the behest of the Supreme Dictator, passing his rules and regulations and enforcing them. Making him de facto Absolute Ruler.
Regarding our twice elected obviously anti-American President, he is doing everything in his power to render the Constitution inoperative and irrelevant. If both Political Parties, both Houses of Congress, the Court and the News Media do not fully support everything he has done, is doing and will do to the Constitution and the office of the Presidency, they have a damned funny way of showing it. They do not oppose, at best, and they fully support, at worst, everything he does, and everything he does is illegal or unconstitutional.
The whole of the federal government has now shown itself to be lawless.
The Prime Minister of Israel, Bibi Netanyahu, speaking to the US Congress, gave us an overdue refresher course in Hard Truth, First Principles and Statesmanship. He may be the last fully decent, competent and dedicated national leader in the world today. He started out with a lot of diplomatic "candy" for our Comrade Obama, peace be upon him, thanking him profusely for past support. Among these "candy" diplomatic statements was this:
That may have sent serious tremors through every Islamic community on earth. "Sensitive and strategic issues ... between an American President and an Israeli Prime Minister"? That can only be interpreted to mean colluding in some plot against Israel's enemies, who are, guess what, Islamic.
The two Islamic factions, pro-Obama and anti-Obama, may have had a major shift in numbers. The ones who thought "we can work with this guy" toward the destruction of America may change sides, and join the ones who want his head on a pike.
The ones who hate him, exemplified by ISIL, would prefer to see him suffer, maybe strike of a hand and a foot on opposite sides, or crucify him entirely so that the birds of the air might feed on his head. Exactly as Mohammed recommended for his enemies. Of course, that's Radical, and Extremist, and Terrorist, rather than true Islamic. We all know how radical, extreme and terrorist Mohammed was, right? Right. Just because he said it, and just because it's in the Koran doesn't mean it's Islamic. Our President has told us, many, many times, that none of these atrocities have anything to do with the religion of Islam.
Remember, Comrade Obama, peace be upon him, has told us that ISIL is not truly Islamic. He described ISIL's behavior as an "indication of the viciousness and barbarity of this organization" and "It also indicates the degree to which whatever ideology they’re operating off of, it’s bankrupt". So it's Mohammed, and the Koran, and ISIL, that are bankrupt, but not Islam. See?
In the reactions and responses to Netanhahu's address to Congress, the whole Marxocrat Party and the ideologically Marxist News Media put their rabid antisemitism and anti-Israel sentiment on vivid display for all the world to see. Again, if they are not antisemitic, and if they are not anti-Israel, they've got a damned funny way of showing it. They are determined to see Iran go nuclear.
So what are we to do? I proposed my idea for a Re-Americanizing Constitutional Amendment back in 2012. I proposed impeaching the President, Senators, Congressmen and Supreme Court Justices among the many Treachery and Treason Pages. And, I wrote all the Fixing America Pages, and the Cut the Spending Pages. I don't know what else to say; I'm running out of words.
We are not getting out of this pickle unless and until the Party system is permanently broken, and we go back to being a No Party America, operating on pure Principle.
The only potential Presidential candidates who are hated by both Parties are, therefore, the least likely to be nominated by either Party, and the Parties are in charge of who gets to be nominated to run. I have said for a long time, and I still say, that the best man for the job is Sarah Palin, but I'm the only one saying it and that doesn't mean much. As it stands now, she's not running anyway.
But I am so sick of hearing "conservatives" talk about how they hate the fact that the Marxocrats and their lap-dog News Media always pick our candidate for us, and then defeat him. And when Sarah Palin is mentioned, these same "conservative" idiots say she doesn't have a chance any more, because the Marxocrats and their lap-dog News Media have successfully destroyed her chances, thereby, allowing the Marxocrats and their lap-dog News media pick our candidate again. And they don't even see it.
The opposition wins because it is allowed to win. No one stands firm.
The only viable possibilities I see, Sarah aside, are Ted Cruz, Mike Lee and Rick Santorum. Take a guess at what the Marxocrat Party, the Republicrat Party, the Marxified News Media and the Marxified entertainment industry are going to do to each of them between now and 2016. And all the "conservative" pundits will let it happen.
In all likelihood, America won't make it to the 2016 election anyway.
Money talks. No one is stopping Obama.
Principle is dieing, and so is America.
We are not going anywhere worth going without God, and the American government left God in the dust long ago.
With my dying breath, I will be a Roman Catholic, and I will be an American Constitutional Absolutist. And that is my final word on it.

Read your article and I agree on almost all your points, with one exception. Ted Cruz is NOT a Natural Born Citizen (NBC). His father is Cuban. Even his mother, though probably a NBC, gave birth to Ted in Canada. So Ted is a Canadian/American. To be a NBC one must be born on U.S. soil of two (both) parents that are American citizens. That's the way the founders understood the term NBC. Also neither Marco Rubio nor Bobby Jindal are not NBCs. Before any one of these can be presidential or Vice-presidential candidates the Constitution would have to be amended, if you are truly an absolutist. But altogether your article on constitutional Absolutism was excellent.

That's an area that is a little fuzzy to me; I'm not sure you are entirely correct. When I was stationed in Germany a guy in my unit married a German girl, and she gave birth to their first baby in Germany. When they got back to the states, as I understand it, that child was considered a natural born citizen, but the wife had to go through the citizenship process, like my grandparents did.
Not certain how it works with civilian Americans abroad, but I strongly suspect that if they give birth overseas the child may be considered a natural born American.
Some time back I read that President Andrew Jackson had told the story of how he was born on a ship on the way to America from Ireland, and if that's true, he was not an NBC and should not have been elected President. He later denied the story and told another one about being born here. But if the new date he claimed he was really born was correct, then, he was only about 12 years old when he picked the famous fist fight with Simon Kenton, and got himself beat half to death.
I know that American military births overseas produce American NBCs. I'm just not sure about civilians in all cases, especially if only one parent is American. You may be right.
Never be lukewarm.
