I never thought I would ever not oppose legalizing illicit drugs, including even the most addictive and dangerous varieties, but here I am. If we would be true to the Constitution, we would have to recognize that fact that, here too, as in so many other areas of corrupted government activity, there are no drugs listed in Article 1 Section 8 of the Constitution.
So they are, Constitutionally speaking, out of scope. The Federal Government has no Constitutional authority to address drugs, in legislation, execution or adjudication of law.
"Regulation", of course, is just as unconstitutional as are the myriad of invented bureaucracies that currently "regulate" and "administer" us, outside the constitution, on behalf of our three constitutional branches of federal government. Call it an unconstitutional delegation of constitutional responsibility and authority.
Even the creation of our national drug policy, and the unconstitutional delegating of "regulating" authority over it to entities like the DEA and the FDA shows how far we have drifted away from Constitutional government since the Prohibition era.
At least, in Prohibition, they knew they had to amend the Constitution in order to ban alcohol. So, they passed Amendment 17 in 1920, giving birth to the Moonshine, rum-running, speak-easy, big-time gangster era, with participation in "criminal activity" involving banned alcohol running from the highest levels of the government to the lowest levels of society.
And a huge and lucrative black market industry in beer and liquor, drawing criminals like manure draws flies.
It was so big that vestiges of it remained even after repeal of the amendment in 1933. To this day there are brewers and distillers who ply their trade just to avoid paying taxes on it.
Prohibition didn't work, because the people, generally speaking, felt they had a right to alcoholic beverages. It was an ingrained right, so strong that laws making it illegal were just impractical. They had the opposite effect, increasing animosity toward the government rather than toward the banned substance.
Carrie Nation may have been right; all the terrible facts about alcoholism are certainly right; the problems associated with alcohol are real, actual problems. But making alcohol illegal just made everything worse.
People will make their own choices is such matters. That's the way it is.
The Controlled Substance Act (CSA) of 1970, signed into law by President Richard Nixon, began America's war on drugs. "Eradication, interdiction and incarceration" were Nixon's goals to end drug abuse.
Just as had happened in the Prohibition experience, the involvement of the criminal element exploded into a gigantic, extremely lucrative black market, and drug abuse went up, not down. It is now a gigantic, multi-trillion dollar industry, rivaling the largest industries in existence, rivaling many if not most national incomes.
The criminal involvement is now far, far worse than the Prohibition era.
Like I said, I never thought I would ever say this. But we need to repeal CSA, and end this nonsense. DEA, like the FDA, has no constitutional reason to continue to exist, as we said in Breaking Regulation, and among the Cut The Spending pages, and among the Fixing America pages.
As we have said elsewhere herein, a Constitutionalist President and/or a Constitutionalist Congress could and should declare the DEA, FDA, BATF and perhaps other bureaucracies to be unconstitutional entities and shut them down. The best DEA and BATF agents, laboratories and valuable investigative facilities could be absorbed into the FBI, but these bureaucracies have no constitutional reason to continue to exist. Standing bureaucratic regulations die with the bureaus.
Note that Alcohol, Tobacco and Firearms are not illegal in America. BATF is an anachronism, even by its own name. There is no reason for any federal tax stamp on cigarette or other tobacco packaging, or on wine bottles or other beverages. As we said in Breaking Taxation, there is no reason for any tax on the American citizenry other than a retail sales tax, collected at the cash register.
Once the various illegal substances are no longer illegal, they will become part of the legal market place, competitively priced by free market sources. What that means is, a sudden elimination of the multi-trillion dollar income of the drug lords.
And, an end to our own multi-billion dollar annual expenditure on our war on drugs.
What about all the addicts?
We will always have them. Perhaps the numbers may go down due to the elimination of the psychological attraction to the "prohibited activity". Perhaps the crime rate will go down due to the lower prices of the substances.
Perhaps not. But our war on drugs quite obviously is not winning.
And no part of it is constitutional to begin with.
Are we a Constitutional Republic, or not?
